To help you make the most of your membership, we have prepared this House Rules. It provides important information on the use of our facilities and services, the rules and regulations of the Club, and essential contact details for your convenience. These guidelines are designed to ensure an enjoyable, safe, and harmonious experience for all members and guests.

Introduction
These Rules are made by TNCL Holdings Sendirian Berhad [Registration No. 202401033164 (1579012-V)] ("the Company"), being the legal owner and operator of The Tapang Club ("the Club"). These Rules shall govern the relationship between the Company, its Members, Registered Dependants, and guests with respect to the use and enjoyment of the Club's facilities and services. Please read all the defined rules established by The Tapang Club provided below.
1. Definitions and Interpretations
1.1 In the Rules unless the context otherwise requires the following words and expressions shall have the meaning ascribed below:
- "the Club" means The Tapang Club.
- "Company" means TNCL Holdings Sendirian Berhad [Registration No. 202401033164 (1579012-V)] and includes its successors in title and permitted assigns.
- "Electronic Platform" means the Club's website, mobile applications or any other electronic or digital platform maintained by the Company, the Management or third parties that can host the information in a secure manner for access by Member.
- "Member" means any person or entity registered as Individual or Corporate Member of the Club and where the context so admits, includes the Member's Registered Dependants.
- "Management" means the Company and/or any person/persons, body or corporation as may be appointed from time to time to control, manage, administer, upkeep and/or maintain the Club.
- "Registered Dependants" means the following persons subject to the approval of the Company at its absolute discretion:
- in the case of Individual Member, the Member's legal spouse and children below the age of eighteen (18) years living in the same abode with the Member and registered as a Registered Dependant until the child attains the age of eighteen (18) years whereupon the child shall automatically cease to be a Registered Dependent; and
- in the case of Corporate Member, the authorised employees, directors and officers of the registered Member; and the Company may from time to time determine the maximum number of Registered Dependants that can be registered under any one Member at any one time.
1.2 "Rules" means the Rules set out herein and includes any amendment thereto, or any new rules promulgated and any by-law and regulations which the Management may from time to time draw up thereunder. In the Rules, unless the context otherwise requires:
- Words importing the masculine gender shall include the feminine and neuter gender and vice versa.
- Words applicable to natural persons include any body, person, company, corporation, firm or partnership, corporate or otherwise and vice versa.
- Words importing the singular shall include the plural and vice versa.
- The headings of Clauses in the Rules are inserted for convenience only and shall not affect the construction or interpretation of these Rules.
1.3 Appendix A – Operating Hours and Appendix B – Booking Fees and Rental Rates are attached to these Rules to provide additional reference information for convenience of Members. These Appendices form part of the Rules, but where there is any inconsistency, the provisions in the main body of these Rules shall prevail. The Management may amend the Appendices from time to time, and any such changes shall be communicated via the Electronic Platform and/or Club notice board.

2. Club Property
2.1 All Club premises, facilities, and equipment remain the property of the Company. No Member shall remove any property of the Club belonging to the Company under any circumstances, damage or vandalise any property of the Club. The Member shall indemnify the Company for any loss or damage caused by them, their Registered Dependants, or guests.

3. Prohibition
3.1 Unless expressly authorized by the Management in writing, no Member or Guest shall:
- Participate in any form of gambling within the Club premises;
- Indulge or engage in any form of political activity, demonstration, protest or campaigning within the Club premises;
- Indulge or engage in any obscene or unruly behaviour whilst within the Club premises;
- Bring on or introduce to the Club any noxious or dangerous substances;
- Use any radio, tape player or any other musical instruments in the Club so as to cause a nuisance or annoyance to other Members therein;
- Bring into the Club or consume therein any food or drinks unless the same shall have been purchased from the Club's food and beverage outlets;
- Give any loan to any employee of the Club or the Company; and/or
- Reprimand or in any way censure an employee of the Management other than by written complaint addressed to the Club manager.
3.2 In addition to Clause 3.1 above, no Member or guest shall:
- Vandalise or wilfully damage any property belonging to the Club, Company, Management, Member or guests;
- Engage in fighting, intimidation, assault, battery or any form of threatening behaviour in the Club;
- Engage in theft or any criminal act;
- Engage in any omission or conduct which in any way brings disrepute upon the Club, its Member or any person working at the Club;
- Publish and/or circulate inflammatory or defamatory statements (either in written or verbal form) which are prejudicial to the interests of the Club;
- Possess, solicit or use drugs or any illegal substances under the law of the country; and/or
- Smoke in non-smoking areas of the Club.

4. Advertisement
4.1 No advertisement may be placed in any part of the Club premises without the prior written approval of the Management.
4.2 The Management may, as a condition for granting permission for putting up an advertisement or notice, impose a levy of such amount as the Management shall see fit.

5. Opening and Closing Hours
5.1 The normal operating hours of the Club (Front Desk/Reception Counter) is from 8.00 a.m. to 10.00 p.m. every day (seven days a week including public holidays) or such other times as the Management may from time to time, at its sole discretion, determine. However, the normal operating hours of the management office of the Club is only from 9.00 a.m. to 5.00 p.m. (Mondays to Fridays) and 9.00 a.m. to 12.00 p.m. (Saturdays), which are not a public holiday, or such other times as the Management may from time to time, at its sole discretion, determine. Without prejudice to any other provisions contained in the Rules, the Management may:
- change or vary the operation hours of the facilities within the Club from time to time at its absolute discretion;
- at any time close the Club or any part thereof for maintenance, cleaning, renovations or repairs or for any other reason which the Management deems fit; and
- at any time and from time to time by notice reserve the whole of or any part of the Club premises including any function rooms for any purpose whatsoever for such period or periods and subject to such provisions and limitations as to entry thereon whether by Member or any other person or class of persons and whether upon terms of payment or otherwise as the Management deems fit.
5.2 The Management shall not be held liable in any way for varying the operation hours of the Club and/or facilities within the Club and/or closing the Club and/or reserving the whole of or any part of the Club premises in the manner provided under Clause 5.1.

6. Membership
6.1 The Club shall have the following categories of Memberships:
- Individual; and
- Corporate.
6.2 A person who is applying to be a Member of the Club shall complete all details and provide all documents required by the Company. Failure to do so may result in the application being rejected. The Company has the absolute discretion to approve or reject any application for membership.
6.3 Upon the approval of the membership application, the Member shall pay the required one-time joining fee prescribed by the Company.
6.4 The Member is required to create an online account using the designated Electronic Platform and the Member shall be solely responsible to keep its account and login credentials including the user names, passwords and other access codes secure. The Management may rightfully assume that any person using the Member's account is the Member (not the Registered Dependant or any unauthorised third party) and all transactions executed or done by the Management pursuant to the Member's instruction made through the designated Electronic Platform shall be binding on the Member. In this regard, the Member agrees that the Club shall not be liable for any loss, cost, or expense incurred by the Member arising from any unauthorised usage. The Member shall bear full responsibility for all consequences of such unauthorised usage.
6.5 The Management shall maintain a computerised database register by Membership Number, Full Name, Identification Card Number, digital image and other data as the Management deems fit.
6.6 Unless otherwise approved by the Company at its absolute discretion, the subscription as a Member and Registered Dependant (referred to in Clause 7.0) shall be on a monthly basis. Any termination shall be in written form and shall only take effect upon the acknowledgement by the Management or the date specified in the termination notice (whichever is the later).
6.7 Monthly subscription fees shall be auto-billed on the first (1st) day of each calendar month. Members shall ensure that sufficient credit balance is maintained in their account wallet to enable the deduction of the prescribed subscription fees. The subscription fees, at the rate prescribed by the Company from time to time, shall be deemed chargeable and shall thereafter be payable on or before the seventh (7th) day of each calendar month, whether or not a formal demand for payment has been issued.
6.8 Without prejudice to other legal and equitable rights and remedies of the Management, any overdue subscription or payable amount to the Management under this Rules shall attract late payment interest at the rate of 1.5% per month calculated on a daily basis.
- Without prejudice to Clauses 6.7 and 6.8, if a Member fails to pay the subscription fees for three (3) consecutive months, the Management reserves the right to suspend the Member's privileges and access to the Club until all outstanding amounts are fully settled.
6.9 For the avoidance of doubt, the Company is providing the Member the right to use and enjoy the Club's facilities subject to the Rules in consideration for the Member paying the prescribed fees. Membership does not confer any equity interest in the Company or the Club. The Club is not an unlisted recreational club as defined under Section 2 of the Capital Markets and Services Act 2007, nor does it constitute a scheme governed under the Interest Schemes Act 2016.
6.10 Freezing of Membership
- Members may request to freeze the monthly subscription by submitting the Freeze Request Form via the Electronic Platform.
- Only full calendar months may be frozen. Requests for partial month freezes shall not be entertained.
- A Member may request to freeze their monthly subscription for a maximum duration of one (1) calendar month per calendar year.
- During the freeze period, the affected account only shall not be permitted to access or utilise any of the Club's facilities. All access credentials will be temporarily deactivated for the duration of the freeze.
- The Management reserves the absolute right to approve, reject, or defer any freeze request, having regard to operational needs and the best interests of the Club.
6.11 Termination of Membership
- Members may request to terminate their memberships by giving at least thirty (30) days' written notice to the Management via the Electronic Platform or in such form as may be prescribed by the Company. Termination shall only take effect upon the Management's written acknowledgment or on the date specified in the termination notice, whichever is later.
- Refunds, where applicable and subject to the Terms and Conditions effective as of the Member's joining date, shall only be processed if the Member has not committed any prior breach of these Rules and has no outstanding dues owed to the Club.
- Upon termination, the Member and their Registered Dependants shall cease to enjoy all privileges and access to the Club's facilities. All associated access credentials or digital authorizations shall be deactivated.
- Any reapplication for membership following termination shall be subject to the Management's discretion and may be declined or subject to payment of new joining fees, particularly where the earlier membership was terminated due to a breach of these Rules.
- The Management reserves the right to impose administrative charges for processing refunds and/or amendments in membership status where applicable.
6.12 Without prejudice to other legal and equitable rights and remedies available to the Company, the Company reserves the right to immediately:
- Suspend the membership of any Member who is subject to investigation for breaching the Rules; or
- Terminate the membership of any Member who commits a serious or irremediable offence, or fails to remedy a remediable breach within fourteen (14) days from the date of notice from the Management.
6.13 The Company shall not be liable for any losses suffered due to suspension or termination. Upon the suspension or termination of the membership of any Member pursuant to this Clause, the privilege granted to his/her Registered Dependants to use the facilities of the Club shall also be automatically suspended or terminated, as the case may be.
In the event of death of an Individual Member, the next-of-kin shall promptly provide the Management with a certified true copy of the Death Certificate, Probate or Letter of Administration and such other documents requested by the Management for administrative purposes. Unless otherwise approved in writing by the Company at its absolute discretion, the membership is not transferrable and in the event of the death of an Individual Member, it shall be the duty of the deceased Member's next of kin to terminate the membership and notify the Company in the manner provided under Clause 6.11(a). For clarity, the heirs, personal representatives, permitted assigns and successors in title (as the case may be) of the Member shall always be liable for any antecedent breach of the deceased Member.

7. Registered Dependants
7.1 Registered Dependants shall be entitled to enjoy the Privilege in accordance with the Rules. For avoidance of doubt, in addition to the joining fee and subscription fees for Member, the Member shall pay for the prevailing joining fee and subscription fees prescribed by the Company for the Registered Dependants.
7.2 The Member shall at all times be responsible and liable for the conduct and behaviour of their Registered Dependants including but not limited to any expenses or charges incurred by the Registered Dependants. Any breach of the Rules by a Registered Dependant shall be deemed to be a breach committed by the Member concerned. All damage or injury to the property of the Club or other persons in the Club caused by any Registered Dependant shall be made good at the expense of the Member concerned. The Member shall indemnify and keep indemnified the Company against all claims and actions arising from the conduct or act of his/her Registered Dependants and on any breach of the Rules by his/her Registered Dependants.
7.3 Persons under the age of eighteen (18) years shall not smoke or consume alcoholic beverages within the Club premises.
7.4 The Management reserves the right to withdraw the Privilege of any Registered Dependants to use the Facilities of the Club or any part thereof as the Management deems fit.

8. Guests
8.1 Subject to the other provisions of the Rules, the Member and/or Registered Dependant of twelve (12) years old or above may bring and accompany guest(s) for sports games (badminton, basketball and pickleball only) PROVIDED ALWAYS that:
- Guest registration is required only for participation in the following sports activities i.e. basketball, badminton, and pickleball (the "Registered Sports Activities"). Such guest(s) must be registered by the Member or Registered Dependant in accordance with Clause 10.4(a) below.
- The applicable guest fees must be paid as prescribed by the Management from time to time;
- Failure to register or pay guest fees shall result in the Member being charged double the prescribed guest fee and must be paid prior to play or use of the sports facilities;
- The Management shall have the right to deny entry of any guest(s) including but not limited to any person whose membership or privilege is suspended or terminated pursuant to Clause 6.11 and Clause 6.12 of the Rules. Guests of Registered Dependants shall be deemed to be guests of the Member, regardless of whether the Member is present at the time of entry or use.
8.2 Member shall be responsible to pay for their guest(s) or their Registered Dependant's guest(s) guest fees, all debts, costs and damages incurred or caused by their guest(s). Member must ensure that their guest(s) or their Registered Dependant's guest(s) comply with the Rules of the Club. Each Member shall be responsible for the conduct of his/her guests.
8.3 Guests who are not participating in Registered Sports Activities may access common Club areas (excluding the gym, swimming pool, sauna, and cold plunge) only when accompanied at all times by their Member-host or the Member's Registered Dependant. Each Member shall remain fully responsible for the conduct and behaviour of his/her guests at all times.
- Registered guests staying in the Club's residences or glamping units may use the Club facilities, except basketball, badminton, and pickleball courts, which are subject to pay-per-use charges.
- Guests registered to play on the basketball, badminton, or pickleball courts and accompanied by a Member shall be subject to guest fees payable by the inviting Member. The applicable rates are set out in Appendix B (Booking Fees and Rental Rates).
8.4 The Management may from time to time impose limitations on the facilities that can be used by the guests as well as in numbers and in frequency of guests a Member can bring to the Club. Without prejudice to the generality of the foregoing and unless otherwise approved or amended by the Management at its absolute discretion, the Member (which includes the Registered Dependants of 12 years old or above) shall only be permitted to bring a maximum of three (3) guests in aggregate to the Club at any one time.
8.5 The Registered Dependant of twelve (12) years or above but not of the age of eighteen (18) or above shall not be permitted to bring in and accompany any guest(s) which is below the age of twelve (12).

9. Conduct of Member and Guest
9.1 No gratuity, tip, monetary gift shall be offered or given to any employee of the Club unless authorised in writing by the Management.
9.2 All Members and Guests shall, at all times while within the Club premises:
- Conduct themselves with decorum and observe courtesy and rules of etiquette while in the Club premises;
- Do not discriminate on the ground of age, gender, disability, race, ethnic origin, nationality, colour, parental or marital status, religious belief, class or social background, sexual preference or political belief; and
- Be appropriately attired as prescribed by the Rules when using the facilities of the Club.
9.3 Member shall ensure that their children and guests below the age of twelve (12) shall at all times be under the control and supervision of the adult Member of at least eighteen (18) years of age. Members shall ensure that their Registered Dependant or guest shall not cause disturbance or annoyance to other Members and guests of the Club.
9.4 Members, guests and other patrons are also reminded that the Club being a family-oriented club, there will be children at the Club premises. Offensive, vulgar, obscene, or otherwise inappropriate language or behaviour, whether directed at other Members, guests, or Club employees, shall not be tolerated.
9.5 Member and Guests shall not make excessive noise or engage in any conduct that, in the opinion of the Management, constitutes a nuisance or causes disturbance to others.
9.6 The unrestrained and excessively loud use of coarse/profane/obscene language in and around the Club is prohibited. Unrestrained and excessively loud coarse/profane/obscene language is deemed to upset the peace and tranquillity and as such is not permissible.
9.7 No Member or Guest shall remove any newspaper, magazine, periodicals or other movable property at the Club without prior written permission of the Management.
9.8 No Member or Guest shall display any posters, notices, etc., in any part of the Club without the prior written permission of the Management.
9.9 No Member or Guest shall bring firearms or other weapons into the Club premises, save for Members who are on-duty personnel of the armed forces, and only with prior notification to the Management.
9.10 Members and Guests shall not litter within the Club and shall be responsible for the disposal of any waste or belongings they bring onto the premises. All rubbish must be disposed of in the designated receptacles provided by the Club.
9.11 No Member or any persons shall be permitted to sell and/or transact for cash consideration or any other form of payment any sporting goods, equipment and related merchandise for swimming, badminton, basketball, and other sports within the Club premises and compound.
9.12 Only sports equipment approved by the Management may be used within the Club. Use of non-approved equipment is strictly prohibited.
9.13 No Member or Guest shall access or enter restricted areas of the Club, including but not limited to service rooms, kitchens, filtration plants, pump rooms, or staff rest areas, except with the prior written approval of the Management.
9.14 Domestic helpers, drivers, or personal staff of Members or Guests shall not be permitted to utilise the Club's facilities or amenities unless they are properly registered and have paid the applicable guest fees.
9.15 No Member or Guest shall bring any pets or domestic animal into the Club premises except in areas specifically designated by the Management for such purpose.
9.16 Members and Guests shall park their vehicles in an orderly manner and strictly within designated parking lots, more particularly set out in Clause 20 and Clause 21.
9.17 Any damage caused to Club property by a Member or his/her Guest shall be made good at the Member's expense. The quantum of such damages shall be assessed solely by the Management, and such assessment shall be final and binding.
9.18 Neither the Company nor the Management shall be liable for the loss or damage to any property brought into the Club by a Member or his/her guest. Member and guest who leave articles or clothing or personal belongings in any part of the Club shall do so at their own risk.
9.19 Neither the Company nor the Management shall be liable for any injury or damage whatsoever, by whomsoever caused to a Member, his/her guests, or to any other person.

10. Indoor Court (Badminton / Basketball / Pickleball)
10.1 Opening Hours
- Open daily from 8.00 a.m. to 10.00 p.m.
- The Management reserves the right to vary the operating hours of the indoor courts or to open, close or reserve the same for such period and purpose as it deems fit, including but not limited to tournaments, exhibitions, and repairs. Any such notice shall be posted on the Electronic Platform or on the notice board of the courts or the Club.
10.2 General Rules
- All children under the age of twelve (12) years are not allowed to use the courts except accompanied and supervised by an adult Member of at least eighteen (18) years old.
- Proper attire shall be worn on the courts, no players shall be without shirt.
- Flat-soled shoes with non-marking soles shall be worn. Shoes with studs or spikes or black soles such as jogging shoes shall not be permitted.
- Only approved types of equipment shall be used. Racquets with sharp edges shall not be permitted.
- Smoking, including electronic cigarettes and vaping is strictly prohibited in the courts.
- No food or beverage shall be consumed or taken into the courts except drinking water.
- Member shall indemnify and hold harmless the Management from and against any loss, cost, or expense arising from damage to any part of the sports hall, including but not limited to the court surface, court carpet, fixtures, fittings, equipment, or any other property, caused by the Member, their Registered Dependants, or their guests.
10.3 Booking Procedures
- Member can make bookings through the designated Electronic Platform. Bookings shall only be deemed confirmed upon payment of the prescribed fees.
- Booking may be made up to FOURTEEN (14) days in advance and shall be limited to two (2) hours per day per Member.
- As a courtesy to other Members, players shall promptly vacate the courts when their session of play ends. Subject to the availability of courts, an extension of a maximum of one (1) hour court time may be made via the Electronic Platform. Such extension requests must be submitted no later than thirty (30) minutes before the scheduled end of the current session, subject to available slots.
- Any cancellation shall be communicated to the Management with at least one day in advance notice period before the start of the booking, failing which the fees paid in advance during the booking shall be forfeited. In addition to the foregoing, the Management reserves the rights to bar the Member from booking the courts up to two (2) months in the event the Member repeatedly fails to cancel the booking of the courts in the manner provided in this Clause 10.3(d). For clarity, any booking made by the Registered Dependant shall be deemed to have been made by the Member and any failure to cancel the booking in the manner provided under Clause 10.3 shall be deemed to be an offence committed by the Member.
10.4 Guest
- Guests are required to be signed in by Members through the designated Electronic Platform prior to the commencement of play. For security and record purposes, the Member shall register the guest by uploading a recent photograph of the guest and entering the guest's full name into the Electronic Platform. Failure to register in this manner will result in the Member being charged twice the amount of guest fees payable. The Management reserves the right to deny entry or playing privileges to any guest who has not been properly registered in accordance with this Clause.
- Member shall play with his/her guests. A guest shall not be allowed to play or continue to play in the event the introducing Member is absent.
- Guests registered to play on the badminton, basketball, or pickleball courts and accompanied by a Member shall be subject to guest fees payable by the inviting Member, at the rates prescribed in Appendix B (Booking Fees and Rental Rates).
10.5 Trainings / Lessons
- Badminton, basketball, pickleball and/or such other suitable trainings or lessons may be conducted by the Club's qualified and authorized coaches or instructors only.
- All registration fees and payments charged for such trainings or lessons shall be transacted at the Management Office or the designated Electronic Platform. No payment shall be made directly to the coaches or instructors.

11. Gym
11.1 Opening Hours
- Open daily from 8.00 a.m. to 9.00 p.m.
- The Management reserves the right to vary the opening hours of the gym, or to open, close or reserve the gym or any part thereof for such period and purpose as it deems fit, including but not limited to tournaments, exhibitions, and repairs. Any such notice shall be posted on the Electronic Platform or on the notice board of the gym or the Club.
11.2 General Rules
- Only Members and Registered Dependants aged twelve (12) years and above who hold a valid Gym Pass through the Club's Electronic Platform are permitted to use the Gym. Registered Dependants below eighteen (18) years of age must be accompanied and supervised by an adult Member aged eighteen (18) years or above. Gym access is strictly limited to Members and Registered Dependants with an active Gym Pass. Gym Membership is optional and subject to the applicable fees prescribed by the Company from time to time. For the avoidance of doubt, Gym Membership fees are not included in the Club membership subscription fees.
- Members are not permitted to bring guests into the gym. Guests are strictly prohibited from using the gym.
- Members intending to use the gym are strongly advised to consult their medical practitioner and/or seek the guidance of a competent and qualified fitness instructor prior to using the gym equipment.
- Any Members on finding a malfunction of any equipment should report the matter immediately to the Club's Manager.
- Gym members shall be properly attired in standard workout clothes and gym wear. Swimming attire, jeans and wet clothing are not permitted in the gym.
- Members are not allowed to exercise bare bodied.
- Non-marking sport/athletics shoes shall be worn.
- Smoking, including electronic cigarettes and vaping is strictly prohibited in the gym.
- No food or beverage shall be consumed or taken into the gym except drinking water.
- All weights and dumbbells and movable equipment are to be returned to the original place after use.
- Gym user should bring along a personal towel to wipe off his/her sweat on the gym equipment and sanitize the equipment with the sanitizer that is provided by the Club after each use for the convenience of other users.
- Members should not tamper with any electrical items, fixtures and fittings.
- Directions and instructions from the Club's Gym Instructor and/or Sports Co-ordinator shall be complied with.
- Members are responsible for ensuring that they and their Registered Dependants hold a valid and active Gym Pass before entering and using the Gym. The Management reserves the right to conduct random spot checks at any time to verify Gym Pass eligibility. Any Member or Registered Dependant found using the Gym without a valid Gym Pass may be required to leave the Gym immediately and may be subject to the applicable Gym Pass charges, penalties, suspension of Gym privileges, or other disciplinary action as determined by the Management.
11.3 Exercise and/or Fitness Classes
- Exercise and/or fitness classes may be conducted by the Club's qualified and authorized coaches or instructors only.
- All registration fees and payments charged for such classes (if any) shall be transacted at the Management office or through the designated Electronic Platform. No payment shall be made directly to the coaches or instructors.

12. Swimming Pool
12.1 Opening Hours
- Open daily from 8.00 a.m. to 9.00 p.m. and will operate without a lifeguard on duty.
- The Management reserves the right to vary the operating hours or to open, close or reserve the swimming pool or any part thereof for such period and purposes as it deems fit, including but not limited to tournaments, exhibitions, and maintenance. Notification shall be posted on the Electronic Platform or the relevant notice boards.
12.2 The swimming pool facilities shall comprise the following or such other facilities as the Management may determine from time to time:
- Adult's pool;
- Children's pool; and
- Jacuzzi pool.
12.3 General Rules
- No person is allowed to swim or sunbathe without swimming attire. Only swimming attire which is approved by the Management may be worn and, in this respect, the Management's decision shall be final.
- All persons shall change into their swimming attire at the changing room only.
- All persons shall shower before entering the pool and wash his/her feet each time he/she re-enters the pool.
- Persons suffering from any infectious, communicable or contagious disease shall not use the pool.
- Spitting or any other unhygienic acts in or around the pools or deck are prohibited.
- No person who is under the influence of alcohol or drugs or any other form of intoxicating substance shall use the pools.
- No person shall consume food and drink in or near the edge of any of the pools.
- Member's children of twelve (12) years old or above but below eighteen (18) years of age who use the swimming pool facilities unaccompanied by a parent/legal guardian shall be deemed to have obtained consent from the Member to use the swimming pool unaccompanied by the said parent/legal guardian. The Member agrees to indemnify the Management in the event of any loss of life or personal injury to the Member's children concerned.
- Member's children who are under eighteen (18) years of age but at least twelve (12) years of age who use the facilities together with guests of twelve (12) years or above shall also be deemed to have obtained consent from the Member for the usage of the swimming pool by the Member's children and guests.
- No child under the age of twelve (12) years shall at any time be near or allowed to use the pool unless accompanied and supervised by an adult Member of at least eighteen (18) years old.
- The use of the children's pool shall be confined to children under the age of twelve (12) years and shall at all times be accompanied and supervised by an adult Member of at least eighteen (18) years old.
- The use of rubber, water gun, air mattresses, toys, balls, kicking board, flippers and any other forms or types of swimming aids are not permitted except arm rings and floats for children. Users under supervised coaching sessions are permitted to use flippers and kicking boards.
- Only appropriate footwear which is approved by the Management may be worn on the pool deck and, in this respect, the Management's decision shall be final.
- All running, pushing, horseplay, dunking or any form of "rough/dangerous play" within the vicinity of and/or in the pool are strictly prohibited.
- Smoking, including electronic cigarettes and vaping is strictly prohibited in the pools and around the pool area.
- All users of the pools are prohibited from using the pools when it is raining and whenever there are thunderstorms/lightning or under other life threatening or emergency situations or circumstances and shall do so immediately when directed or instructed by any personnel authorised by the Management with long whistle blasts.
- The pool filtration, mechanical and electrical rooms are strictly out of bounds to any person except for authorized personnel.
- Members or guests shall not interfere with any fittings, equipment or machinery of any kind used in connection with or around the facilities areas of the swimming pools, or other ancillary areas.
- The use of the swimming pool is strictly prohibited during closing hours.
- Every Member is responsible for his/her own safety and that of his/her guests and all members of his/her family.
- The Member concerned hereby agrees to indemnify the Management against any claims whatsoever by the parent/Legal Guardian or next of kin of any parties in the event of loss of life or personal injury to the Member's children and/or guests brought by his or her children to the swimming pool.
- The Management shall not be held liable for any injuries or mishaps occurring within or around the swimming pool unless due to the wilful or negligent act of the Management.
12.4 Training / Lessons
- Swimming, lifesaving and/or other aquatics trainings or lessons may be conducted by the Club's qualified and authorized coaches or instructors only.
- All registration fees and payments charged for such trainings or lessons shall be transacted at the Management office or the designated Electronic Platform. No payment shall be made directly to the coaches or instructors.

13. Changing Room
13.1 Facilities
- The changing room facilities may comprise the following facilities or such other facilities as the Management may determine from time to time:
- Lockers;
- Shower rooms; and
- Changing cubicles;
- Sauna;
- Cold plunge.
13.2 Opening Hours
The Changing Room shall be open daily from 7.00 a.m. to 10.00 p.m. The Management shall have full control over its operation and may at any time vary the operation hours or may open, close or reserve the changing rooms or any part of the changing room facilities for such reason as the Management shall deem fit, by posting a notice on the Electronic Platform or the notice board of the changing room or the Club.
13.3 General Rules
- Smoking, including electronic cigarettes and vaping is strictly prohibited in the changing rooms and all of its facilities.
- Boys who are five (5) years old or above are not allowed in the ladies' changing room and no girls are allowed in the men's changing room.
- Lockers are available to Members free of charge on a first come first serve basis.
- Members shall keep lockers clean and tidy at all times and no articles shall be left overnight in lockers which are designated for daytime use only.
- The storage of food-stuff, weapons, banned publications, illegal drugs etc. in lockers is strictly prohibited.
- Members are solely responsible for articles deposited in the lockers or left in the changing rooms. Any articles found after 10.00 p.m. will be removed without any liability on the Management.
- The Company and Management shall not be held liable for any loss or damage to articles kept in lockers or otherwise left in the Changing Room by Members or their guests.

14. Residences and Glamping
14.1 Check-In and Check-Out
- Check-in time for all Residence and Glamping units is from 2:00 p.m. onwards.
- Check-out time is strictly before 12:00 p.m. (noon). Late check-out may incur additional charges, subject to availability and prior approval by Management.
- The Management reserves the right to refuse check-in of guests with unpaid dues or those in breach of Club rules.
14.2 Cancellation of Booking
Residence and Glamping bookings may only be cancelled through the designated Electronic Platform not less than five (5) days before the scheduled check-in date. No cancellation or refund shall be allowed for cancellation requests made within five (5) days of the scheduled check-in date, unless otherwise approved by the Management at its absolute discretion.
14.3 Conduct and Responsibility for Guests
- Members booking Residence or Glamping units shall be fully responsible for their guests' conduct throughout the stay.
- Member booking a Residence or Glamping unit for a guest must be physically present at the Club at the time of the guest's check-in.
- Member's registered guest may charge dining or other expenses incurred during their stay to the room. All such charges must be fully settled by the guest upon check-out.
- In the event the registered guest fails to settle any outstanding charges upon check-out, the full amount shall be borne by the booking Member.
- Lodging guests who are not registered shall not be permitted to utilise the "charge to room" facility.
- Any damages, misconduct, nuisance, or breach of the Club's House Rules by guests shall be deemed the responsibility of the booking Member.
- All guests must comply with all Club rules, including noise control, proper attire, and respectful use of shared facilities.
14.4 Maximum Occupancy & Charges
- Each Residence and Glamping unit shall accommodate a default number of persons as prescribed in Appendix B.
- The maximum permitted occupancy per unit, and any additional charges for extra persons, extra beds, or surcharges (including weekends and public holidays), shall be as set out in Appendix B (Booking Fees and Rental Rates).
- The Management reserves the right to vary the maximum occupancy, charges, and surcharges from time to time at its absolute discretion.
14.5 Guest Vehicle Access
Only one (1) guest vehicle per Residence or Glamping booking is entitled to free parking during the stay. Additional vehicles shall be subject to guest parking charges as imposed by the Club.
14.6 Noise, Smoking, and Cleanliness
- Quiet hours must be observed from 10:00 p.m. to 7:00 a.m.
- Smoking is strictly prohibited inside all Residence and Glamping units.
- Guests are required to maintain cleanliness and dispose of waste appropriately. Any cleaning required beyond normal housekeeping will be charged to the Member.

15. Business Lounge / Children's Corner
15.1 Opening Hours
Open daily from 8.00 a.m. to 9.00 p.m. The Management shall have full control of the Business Lounge / Children's Corner and may at any time vary the operation hours or may open, close or reserve the Business Lounge / Children's Corner or any part thereof for such reason as the Management shall deem fit, by posting a notice on the Electronic Platform.
15.2 General
- Smoking, including electronic cigarettes and vaping is strictly prohibited.
- No food or beverage shall be consumed or taken into the Business Lounge / Children's Corner except drinking water.
- Swimming attire and wet clothing are not permitted in the Business Lounge / Children's Corner.
- No shoes/slippers are allowed in the Business Lounge / Children's Corner.
- No dangerous or sharp objects may be taken into the Business Lounge / Children's Corner.
- No use of loud, foul or abusive language.
- No shoving, chasing, rough play, playing balls with racquets or engaging in throwing games.
- Children below the age of twelve (12) shall be accompanied by an adult Member of eighteen (18) years old or above at all times.
- Any child who is sick or suffering from any contagious disease may not be allowed to enter the Business Lounge / Children's Corner.
- Children may bring games (electronic/non-electronic), books and other safe materials into the Business Lounge / Children's Corner.
- Any toy brought in by a child which is considered dangerous may be confiscated from the child and returned to the accompanying adult Member.
- Members or guests are not allowed to borrow or bring out books or other reading materials.
- All reading materials shall be returned to their original place after use.
- Members or guests shall not tear, mutilate, deface or abuse any of the reading materials.
- Children who cause disturbance or annoyance to other children may be asked to leave the room.
- Members shall be responsible for the safety of their children, their guests and their belongings in the Business Lounge / Children's Corner.
- Users shall not tamper with any equipment, fixtures and fittings etc.
- The Business Lounge / Children's Corner's furniture or materials are not to be removed from the room.
- Members shall be liable for any damage to the furniture, equipment, fixtures and fittings, or loss of reading materials.
- All complaints or suggestions shall be in writing to the Management.
- The Management will not be held responsible in any way for any loss, illness, accident, harm or fatality arising from using the Business Lounge / Children's Corner facilities.

16. Food & Beverage
No outside food and/or drinks are allowed in the Club without prior written approval from the Management. Such approval shall in any case be limited to baby food or food for medical reasons only.

17. Restaurant & Café / Alfresco
17.1 Opening Hours
Open daily from 9.00 a.m. to 10.00 p.m. Last orders shall be taken no later than thirty (30) minutes before closing time. The Management reserves the right to vary the operating hours or to open, close, or reserve the restaurant or café/alfresco or any part thereof for any reason deemed fit by posting a notice on the Electronic Platform or on the notice board of the Restaurant or the Club.
17.2 Dress Code
Patrons wearing swim attire, wet clothing or wet swimwear are not permitted to enter the restaurant or café/alfresco.
17.3 Reservation
- Tables in the restaurant and alfresco may be reserved through the Electronic Platform. Reservations will be accepted on a first come first serve basis. The choice of table is not guaranteed.
- A booking for table(s) not taken up fifteen (15) minutes after the reserved time, without any notification, will be deemed to have been cancelled without notice.
17.4 Food Policy
The restaurant and café/alfresco are pork-free establishments. All menu items are prepared without pork or pork-derived ingredients.

18. Wine Bar
18.1 Opening Hours
Open daily from 9.00 a.m. to 10.00 p.m. The Management reserves the right to vary the operating hours or to open, close, or reserve the wine bar or any part thereof at its discretion by posting a notice on the Electronic Platform or the Club's notice board.
18.2 Corkage
A corkage fee, as determined by the Management, shall be applicable for every bottle of wine and/or liquor brought into the premises.
18.3 Dress Code
Patrons wearing swim attire, wet clothing or wet swimwear are not permitted to enter the wine bar.
18.4 Age Restriction
Only Members and Guests aged twenty-one (21) years or above, or who have attained the legal drinking age in Malaysia, whichever is higher, shall be permitted to purchase or consume alcoholic beverages within the wine bar. Proof of age may be requested by the Management or staff at any time, and service may be refused to any person unable to provide satisfactory identification.

19. Farmhouse Access and Conduct
19.1 Operating Hours
The farmhouse is open daily as set out in Appendix A (Operating Hours), including weekends and public holidays, unless otherwise notified by Management. The Management reserves the right to vary the operating hours or close the farmhouse or any part thereof as it deems fit, including for maintenance, private events, or safety reasons, by posting a notice on the Electronic Platform or on the notice board of the Farm or the Club.
19.2 Member and Guest Access
- Members and their Registered Dependants may visit the farmhouse during operating hours without prior booking.
- All guests must be accompanied by a Member or Registered Dependant at all times.
- The Management reserves the right to restrict or suspend access to the farmhouse, whether in whole or in part, during maintenance works, harvesting activities, or events organised by the Club or third parties.
19.3 Conduct and Safety
- All guests shall comply with all instructions issued by the Farm's staff and observe all signage displayed within the farmhouse premises.
- Picking of produce or handling of tools and equipment is strictly prohibited unless under the supervision of farmhouse staff or during guided sessions.
- Children under the age of twelve (12) must be supervised by an adult Member at all times while on the farmhouse.
- Guests must stay within the designated walking paths and are prohibited from entering greenhouse or restricted areas without prior permission.
19.4 Attire and Cleanliness
Guests are advised to wear appropriate attire and footwear suitable for farmhouse visits. Littering is strictly prohibited. Members are responsible for the conduct, hygiene, and cleanliness of their guests during the visit.

20. Car Parking
20.1 Access to the Club's car park shall be controlled via a Vehicle License Plate Recognition System (VPRS) or any other system as determined by the Management from time to time.
20.2 Subject to the availability of parking spaces, Members may apply to register one or more vehicles through the designated Electronic Platform. All applications shall be subject to the Management's approval and payment of the applicable fees prescribed by the Management from time to time. The Member shall submit the relevant vehicle registration document for each vehicle. Where the registered owner of the vehicle is not the Member or the Member's Registered Dependant or spouse, the Management may require such additional supporting documents as it deems necessary to verify the Member's entitlement to or lawful use of the vehicle. Any vehicle not approved or registered under this Clause shall be subject to the prevailing parking fees imposed by the Company. The Management's decision shall be final and binding.
20.3 All vehicles shall be parked at the owner's own risk and in an orderly manner and within the lines drawn for parking of vehicles.
20.4 The Management reserves the right to clamp vehicles which are in violation of these Rules or in a manner deemed obstructive or inappropriate.
20.5 A clamped vehicle shall only be released upon payment of the prescribed release fee, as determined by the Management.
20.6 Washing of any vehicles is not permitted in the car park.
20.7 No vehicle shall be parked overnight in the Club's car park, except with the prior written permission of the Management or where the vehicle belongs to registered residential or glamping guests.
20.8 All drivers of any vehicles entering the Club premises shall comply with these Rules, adhere to proper etiquette and accord due courtesy to Members and other Visitors to the Club, not cause any obstruction to any party, and comply with all other such regulations as may be issued by the Management from time to time.
20.9 The Management and its staff shall not be liable to any vehicle owner for any personal injury, loss of property, and other loss and damage, cost and action whatsoever or howsoever incurred or suffered by the vehicle owner or his passengers due to the use of the car parking bays or actions taken by the Club's staff for infringement of this by-law.

21. Motorcycle and Bicycle
21.1 All motorcycles and bicycles shall be parked only in the designated motorcycle parking areas and bicycle racks. The Club and the Management shall not be responsible for any loss or damage howsoever arising to such vehicles.
21.2 Other than the designated places stated in Clause 21.1, motorcycles and bicycles are not to be brought inside the Club premises.
21.3 No motorcycles or bicycles shall be parked overnight in the Club's premises, except with the prior written permission of the Management or where the motorcycles and bicycles belong to registered residential or glamping guests.
21.4 If a motorcycle or bicycle is found to be indiscriminately parked, a notice shall be affixed on the motorcycle or bicycle stating violation of the Club's motorcycle or bicycle parking policy. The notice shall instruct the owner to remove the motorcycle or bicycle within twenty-four (24) hours from the time of the issuance of the notice, failing which the Management shall have the absolute power and authority to remove or dispose of the motorcycle or bicycle in any way it deems fit. A motorcycle or bicycle shall be deemed indiscriminately parked when it is:
- Creating an obstruction such as blocking an entrance, an exit or walkway;
- Creating an immediate hazard or damaging Club property, including tainting the walls with tyre markings;
- Secured to a handrail;
- Occupying a facility reserved for persons with disabilities;
- Parked in any area other than the designated racks for bicycle parking or motorcycle parking, as the case may be; and/or
- Parked overnight without prior permission obtained.
21.5 The Management shall not be liable for any cost incurred from replacement, loss and/or damage resulting from the removal or disposal of abandoned motorcycles and bicycles or indiscriminately parked motorcycles and bicycles.

22. Miscellaneous Provisions
22.1 Use of all the other facilities of the Club shall be subject to such rules, regulations and by-laws as may be prescribed and amended by the Company from time to time in the manner set out in Clause 23.
22.2 The Company shall have the absolute discretion to appoint, delegate, assign, or subcontract any person, firm, or entity to operate or manage any part of the Club's facilities, upon such terms and conditions as the Company may deem appropriate.

23. Amendments to the Rules and Adding New Rules and By-Laws
The Management may from time to time, at its absolute discretion, add to, amend, or repeal these Rules and/or introduce, vary, or revoke any by-laws or regulations for the regulation and administration of the Club. Such amendments or additions shall come into effect and be binding upon all Members upon the expiry of fifteen (15) days from the date they are published or posted on the designated Electronic Platform, or on such other date as may be specified therein.

24. Notices
24.1 Unless otherwise stated herein, any notice or document may be served by the Company or Management on a Member:
- Personally;
- By prepaid post to the Member's last known address in Malaysia; or
- In electronic form to the Member's last known email address or via publication on the designated Electronic Platform.
24.2 Any notice or document served shall be deemed duly served:
- If delivered personally, on the date of delivery;
- If sent by post, on the day the letter is posted, and proof of proper addressing, prepayment, and posting shall be sufficient proof of service; and
- If sent electronically, at the time of transmission or on the date of first availability on the Electronic Platform, as the case may be.

25. Disclaimer
25.1 Use and access to all the Club's facilities including but not limited to indoor and outdoor courts, gym, swimming pool, farmhouse, seminar rooms, function halls, glamping, residences and other Club amenities shall be at the sole risk of the Member, and their Registered Dependants and guests. The Company and the Management shall not be liable for any loss, damage, injury, or death suffered by any person arising out of or in connection with the use of the Club's facilities, except where such loss, damage, injury, or death is directly caused by the wilful misconduct or gross negligence of the Management. The Member acknowledges that it is impractical for the Management to monitor the usage of the Club's facilities by the Member (including the Registered Dependant) and/or the guest at all times. Hence, the Member shall be solely responsible to monitor, supervise and control his or her Registered Dependant and/or guest even if they are not accompanied by the Member concerned.
25.2 The Member shall fully indemnify, defend and hold the Company and/or the Management harmless from and against all claims, demands, costs, losses, expenses and liabilities (including full legal costs on an indemnity basis) arising from or in connection with:
- Any breach of these Rules by the Member, their Registered Dependants or their guests; and/or
- Any act, omission or conduct of the Member, their Registered Dependants or their guests.
25.3 In addition to the above, the Member shall fully indemnify, defend and hold the Company and/or the Management harmless from and against all claims, demands, costs, losses, expenses and liabilities (including full legal costs on an indemnity basis) arising out of or in any way connected with claims made by their Registered Dependant and/or guest.

26. Personal Data Protection Notice
26.1 General
- The Company respects the privacy of all Members and is committed to protecting their personal data.
- This Personal Data Notice ("Notice") outlines how the Company collects, uses, discloses, and protects personal data through the membership process, communications with the Management, usage of the Electronic Platform, and other sources, including public and regulatory records.
- In compliance with the Personal Data Protection Act 2010, this Notice is prepared in dual language (English and Bahasa Malaysia — BM Version). In the event of any inconsistency between the English and Bahasa Malaysia version, the English version shall prevail.
- The Company reserves the right to update or amend the terms of this Notice at any time by notifying the Member. By continuing to be a member of the Club following the updates or amendments to this Notice, this shall signify the Member's acceptance of such updates or amendments.
- By subscribing to the Club's membership, the Member consents to the collection, use and disclosure of the Personal Data and represents that he/she has the full authority from his/her Registered Dependant and guest to permit the Company to collect, use and disclose their Personal Data in the manner provided in this Notice.
- Unless otherwise stated, the Member is obligated to provide the required information particularly during the membership registration and registration of Registered Dependant and guest. Should the Member fail to provide the obligatory information, this may result in the Company being unable to process membership applications or provide relevant services, products and facilities.
26.2 Collection and Use of Personal Data
- The Company may collect and process personal data of the Member (which includes his/her Registered Dependants and guests) including but not limited to: names, contact details, identification information, preferences, family particulars, bank account information, and digital images ("Personal Data").
- The Company may use and process the Personal Data for purposes relating to the services it offers and for the Company's business activities, which include but are not limited to:
- Processing transactions or use of any of the services, products and/or facilities provided by the Club;
- For internal administrative purposes;
- Complying with legal and regulatory obligations and recommendations;
- To conduct research and data analytics to enhance the services, products and/or facilities provided by the Club;
- Ensuring that the marketing activities and communications are relevant to the Member's interests, which includes customer profiling, targeted advertising, administering promotions, and informing the Member about important notices, events and discounts;
- Ensuring safety and security, which includes but is not limited to the use of the digital image for the Club's facial recognition system;
- Other reasonable purposes related to the provision of the services, products and/or facilities at the Club.
26.3 Disclosure to Third Parties
The Company may engage other third parties to perform functions on the Company's behalf, and consequently may provide access or disclose the Personal Data to third parties such as those listed below (which list shall not be exhaustive):
- Appointed contractors and agents to manage or provide any services, products and/or facilities at the Club;
- Appointed contractors and agents to provide incidental services in relation to the management of the Club such as information technology (IT) service providers and storage facility providers;
- Banks and financial institutions;
- Insurance providers;
- Any professional advisors and external auditors, regulatory and governmental authorities in order to comply with statutory and government requirements;
- In the event of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organisation ("Transaction"), the personal data may be required to be disclosed or transferred to a third party as a result of the Transaction. The Member hereby acknowledges that such disclosure and transfer may occur and permits the Company to release the personal data to the other party and its advisers/representatives;
- The Personal Data may be transferred out of Malaysia, stored, used and processed in a jurisdiction other than Malaysia for the purposes described above where such third parties are located outside of Malaysia. The Member understands and consents to the transfer of the Personal Data out of Malaysia as described herein.
26.4 Access, Correction Requests and Inquiries
Subject to any exceptions under applicable laws, the Member may at any time hereafter request to:
- Access their Personal Data;
- Correct or update the Personal Data;
- Restrict the processing of the Personal Data; or
- Seek further information from the Company regarding the processing of the Personal Data by contacting the Club's designated data protection contact person.

Appendix B – Booking Fees and Rental Rates
This Appendix sets out the current booking fees and rental rates for the Club's facilities for reference purposes. All rates are subject to change by the Management from time to time. The applicable rates at the time of booking shall be as published on the Electronic Platform or communicated by the Management.
